1. Who we are
Reef Network is operated by Deepline Digital LLC, a limited liability company formed under the laws of Wyoming, United States, with its registered address at 30 N Gould St, Suite 56278, Sheridan, WY 82801, United States. In these terms, “Reef Network”, “we”, “us” and “our” mean Deepline Digital LLC. Our full contact details are in the Legal Notice.
2. Acceptance of terms
By accessing or using Reef Network, you agree to comply with and be bound by these terms and all applicable laws and regulations. If you do not agree, do not use the platform.
3. Documents that form part of these terms
The following documents are annexes to these terms and form part of them. By accepting these terms you accept them as well. Each is available at any time from the footer of every page.
The Privacy Notice and the Cookie Notice are not annexes to these terms. They explain how we handle your information and they are not something you agree to by accepting these terms. Where consent is needed for a specific use of your information, we ask for it separately.
If an annex conflicts with these terms, these terms prevail, except where the annex states otherwise.
4. Description of service
Reef Network provides digital content, community tools, and informational resources focused on saltwater aquariums and reef ecosystems.
Reef Network currently publishes editorial articles and a species encyclopedia. We do not sell products, livestock or paid services on this website. The encyclopedia is built on catalogue software for structural reasons only: its entries carry no price, no checkout and no availability, and they are not offers for sale. Features that are still in development are not part of the service until we announce them.
5. Eligibility and age
You must be at least 13 years old to create an account. If you are in the European Economic Area, the United Kingdom, or another country that sets a higher age for consent to online services, you must be at least 16, or the age set by the law that applies to you if it is higher.
We do not knowingly collect personal information from children under 13. If we learn that we have, we delete it.
If you are under 18, you may use Reef Network only with the involvement of a parent or guardian.
6. User accounts
To access certain features, you may be required to register an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Tell us at info@reefnetwork.com as soon as you believe your account has been used without your permission.
You must give accurate information when you register and keep it up to date. One person may hold one account.
7. User conduct
What you may and may not post is set out in full in the Community Guidelines, which form part of these terms. In summary, you agree not to post content that is unlawful, infringing, misleading in a way that could harm an animal, abusive, or commercial without disclosure.
Where we restrict or remove content, or restrict, suspend or terminate an account, we act in accordance with section 4 of the Community Guidelines, we tell you why, and you may appeal.
8. Intellectual property and your licence to us
Our content: The articles, encyclopedia entries, database structure, branding, visual assets and design of Reef Network are owned by us or used under licence, and are protected by copyright and other laws. You may not copy, republish, systematically extract, or use them to train machine learning systems without our written permission. Short quotations with a visible link back to the source page are permitted.
Your content: You keep ownership of everything you post. You are responsible for having the rights to post it.
The licence you grant us: By posting content on Reef Network you grant Deepline Digital LLC a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to host, store, reproduce, adapt, resize, crop, compress, watermark, translate, publish, display and distribute that content, in whole or in part, for the purpose of operating, promoting and improving Reef Network and its sections in any language version of the site.
Attribution: Where you post a photograph, we publish it with the display name on your account unless you ask us to publish it without attribution.
What happens if you delete it: You may delete your content at any time. When you do, we stop displaying it within a reasonable period. The licence continues only for copies that are already in backups, in cached copies held by others, and in material that others have already lawfully shared, and only until those copies expire in the ordinary course.
Contributions to the encyclopedia: Contributions to the species encyclopedia and other editorial sections are covered by a separate agreement, which we present to you before you contribute.
9. Indemnity
You agree to indemnify and hold harmless Deepline Digital LLC, its officers, employees and agents against any claim, loss, liability, cost or expense, including reasonable legal fees, arising out of content you post, your use of Reef Network, or your breach of these terms or of any law.
10. Disclaimers and limitation of liability
No warranty: Reef Network is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy and non-infringement. The full disclaimer is in the Disclaimer, which forms part of these terms.
Livestock: Information about the keeping, feeding, dosing, compatibility and health of marine animals is educational. We do not guarantee the survival, health or behaviour of any animal, and we are not liable for loss of livestock.
Limitation: To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or livestock, arising out of your use of Reef Network.
Cap: To the fullest extent permitted by law, our total liability to you for all claims arising out of or relating to these terms is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred United States dollars (USD 100).
What is not excluded: Nothing in these terms excludes or limits liability that cannot be excluded or limited under the law that applies to you. Some jurisdictions do not allow certain exclusions, and in those jurisdictions the exclusions above apply only to the extent permitted. If you are a consumer in the European Union, the United Kingdom or Turkey, your mandatory statutory rights are not affected by these terms.
11. Termination
By you: You may close your account at any time from your account settings, or by writing to info@reefnetwork.com. Closing your account does not automatically delete content you posted publicly. To have that removed, delete it before closing, or ask us.
By us: We may restrict, suspend or terminate your account in accordance with the Community Guidelines. Except where we are legally prevented from doing so, or where the account is being used for illegal activity, we tell you why and you may appeal.
Survival: Sections 8, 9, 10, 13 and 14 survive termination.
12. Changes to the service and to these terms
Changes to the service: We develop Reef Network continuously and sections may be added, changed or withdrawn. Where a change materially reduces a feature you rely on, we give notice on the site.
Changes to these terms: We may update these terms. Where a change is material, we give at least 30 days’ notice by posting the updated terms with a new date at the top and, if you have an account, by email or by a notice when you next sign in. If you do not accept the change, you may close your account before it takes effect. Continuing to use Reef Network after the effective date means you accept the updated terms. Changes never apply retroactively.
13. Governing law and disputes
Governing law: These terms and any dispute arising out of them are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules.
Consumers elsewhere: If you are a consumer resident in the European Union, the United Kingdom or Turkey, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country.
Informal resolution first: Before starting formal proceedings, write to legal@reefnetwork.com and give us 30 days to resolve the matter.
Where disputes are heard: The state and federal courts located in Sheridan County, Wyoming have exclusive jurisdiction, subject to the paragraph on consumers above.
14. General
Severability: If any provision is found unenforceable, the rest remains in force.
No waiver: If we do not enforce a provision, that is not a waiver of it.
Assignment: You may not assign these terms. We may assign them to a successor in connection with a merger, acquisition or sale of assets, on notice to you.
Entire agreement: These terms and their annexes are the entire agreement between you and us about Reef Network, and replace any earlier version.
Force majeure: We are not liable for failure to perform caused by events beyond our reasonable control.
Notices: We send notices to the email address on your account. You send notices to legal@reefnetwork.com and to the postal address in the Legal Notice.
Language: The English version of these terms is the governing version. Translations are provided for convenience.
