Copyright and DMCA Policy

This policy is an annex to the Conditions of Use and forms part of them.

1. Our content

The articles, encyclopedia entries, photographs, illustrations, database structure, branding and design of Reef Network are owned by Deepline Digital LLC or used under licence. They may not be copied, republished, scraped or used to train machine learning systems without our written permission.

Short quotations with a visible link back to the source page are permitted.

2. Your content

You keep ownership of what you post. The licence you grant us when you post is set out in the Conditions of Use. Posting content you do not own, or do not have permission to use, is a breach of those terms.

3. Reporting copyright infringement

If you believe material on Reef Network infringes your copyright, send a written notice to our designated agent. Under 17 U.S.C. 512(c)(3)(A) your notice must include all six of the following:

1. A physical or electronic signature of a person authorised to act on behalf of the owner of the exclusive right that is allegedly infringed.
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list.
3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it, such as the full URL of the page.
4. Information reasonably sufficient to permit us to contact you, such as your address, telephone number and email address.
5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

A notice that is missing any of these elements may not be effective.

4. Designated agent

This agent is registered with the United States Copyright Office DMCA Designated Agent Directory.

5. What we do when we receive a notice

We review the notice, and where it is complete and appears valid we remove or disable access to the material expeditiously. We notify the user who posted it and give them a copy of the notice and a copy of this policy.

6. Counter notification

If your material was removed and you believe the removal was a mistake or a misidentification, you may send a counter notification under 17 U.S.C. 512(g)(3). It must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed and the location at which it appeared before it was removed.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
4. Your name, address and telephone number, a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who gave the original notice or their agent.

If we receive a valid counter notification, we forward it to the person who sent the original notice. Unless that person notifies us that they have filed a court action seeking to restrain the activity, we may restore the material not less than 10 nor more than 14 business days after we receive the counter notification.

7. Misrepresentation

Under 17 U.S.C. 512(f), a person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys’ fees. Send notices in good faith.

8. Repeat infringers

In accordance with 17 U.S.C. 512(i)(1)(A), we have adopted and we implement a policy providing for the termination, in appropriate circumstances, of the accounts of users who are repeat infringers.

We record each accepted notice against the account that posted the material. Three accepted notices within twelve months will normally result in termination. We may act sooner in clear or severe cases, and we take valid counter notifications into account.

9. Users outside the United States

If you are in the European Union you may also report illegal content, including copyright infringement, through the reporting route described in our Community Guidelines. We will give you a statement of reasons for the action we take and an opportunity to appeal.

10. Trade marks and images

For trade mark complaints, or for photographs used under a licence you believe has been exceeded, write to copyright@reefnetwork.com with the same level of detail set out in section 3.
